地方性国土空间规划立法中存量规划入法研究

Deliberation and Design of Built Area Planning in Local Territory Spatial Planning Legislation

存量规划入法问题,是在规划变革期、发展转型期建构空间规划法律体系的过程中需要重点考虑的方面。文章从地方性国土空间规划立法的视角切入,溯源现行空间类规划地方立法中的存量规划思想,评析地方性国土空间规划立法中存量规划入法的实践,并对其进行检讨;在此基础上,从立法形式、表达方式和体例结构3个方面提出地方性国土空间规划立法中存量规划入法的框架体系,并重点从总则、规划制定与修改、用途管制与空间治理、规划实施、监督检查和法律责任及立法解释等方面分章节探索了存量规划入法的内容要点与表述技术,初步搭建了增存并举的理论框架和立法路径,以期为各地国土空间治理体系和治理能力的法制化建设提供参考。

The problem of built area planning into law is an important aspect to be considered in the legislative construction of spatial planning during the period of planning reform and development transformation.From the perspective of the legislation of local territory spatial planning,this paper,by tracing ideas of built area planning in the local legislation of spatial planning,examines the legal practice of built area planning in the exploration of local legislation of territory spatial planning,and makes a historical investigation and realistic review of its legislative practice.It discusses the the framework of the local legislation of territory spatial planning from legislative form,expression mode,and style structure of built area planning input method.Then,focusing on general rules,planning,formulation and modification,use control and space management,planning,implementation,supervision and inspection and legal liability,and legislative interpretation,this paper explores the content points and expression techniques of built area planning in different chapters,and sets up a primary theoretical framework and legislative path including both built-up and expanded areas,so as to provide a reference for the legalization of land-space governance system.
