国土空间规划体系中公众参与的法律制度研究

Research on Legislation of Public Participation in the National Territory Spatial Planning System

法律制度是当前我国国土空间规划体系改革的基点。在以人为本的价值导向下,加强公民行政参与权的保障、完善公众参与的法律制度是国土空间规划法制体系建设中不可或缺的内容。那么,如何完善相关法律规范,以保障公众参与权的正当性并具有效力,是值得思考的问题。文章依据“理论基础—正当性准则—法律规范—程序效力”的逻辑框架,重新审视沟通式规划理论的本质内涵,依据沟通理性提出公众参与程序正当性的3条衡量准则。在此基础上,基于对我国现行空间规划法律法规中公众参与相关制度的评价,并结合国土空间规划体系改革中不同层级的规划要求,有针对性地探讨进一步完善规划公众参与法律制度的建议,以期以沟通理性为准则提升并规范行政参与权的行使效力,为推动国土空间规划法制体系的建设和加强现代化的多元治理能力提供参考。

Legal system is the foundation for the reform of the national territory spatial planning system.With the‘people first’concept,ensuring public participation in administration by legislation is indispensable in the establish of the national territory spatial planning system.Based on the logic framework of“theoretical foundation,rightness principle,legal regulation,procedural efficacy”,the paper reexamines the essence of communicative planning theory,and puts forwards three principles of evaluating the rightness of public participation procedure.Based on the evaluation of current institution of public participation and requirements in the national territory spatial planning system at different levels,the paper discusses ways of integrating public participation legislation system,to regulate and improve the efficacy of public participation based on the‘communicative rationality’and to promote modern governance by legislation.
