上海市公共场所卫生许可告知承诺中撤销问题的探讨

Research on the Cancellation Procedure of the Notice and Commitment System in Public Place Health Permission in Shanghai

在公共场所卫生许可中实施告知承诺,是上海市卫生健康行政部门在行政审批制度改革的大背景下,为优化审批流程,提高行政效率,强化事中事后监管而做出的努力。但由于与之相配套的行政许可撤销制度的不完善,在一定程度上影响了公共场所卫生许可告知承诺的推行成效。本文从界定不同的撤销情形入手,探讨如何构建合理的公共场所卫生许可告知承诺撤销的正当程序,并从执法实践角度建议规范文书送达程序。

Shanghai Municipal Health Commission has deepened the reform of administrative approval and informed the notice and commitment system in public place health permission in recent years.These measures simplified the administrative procedures,shortened the permit time,and strengthened the regulation during and after the event.However,problems were born with the implementation of the notice and commitment system because of the imperfection in the cancellation procedure.This article analyzed different conditions of cancellation and discussed how to construct the cancellation procedure of the notice and commitment system in public place health permission rationally.This article also gave some advices for the service of documents in the practice of law enforcement.
