平衡论视角下我国药师法律制度构建探讨

Discussion on the Construction of Pharmacist Law in China from the Perspective of Balance Theory

从药师立法实践来看,日本、中国台湾的“药师法”体现了管理论的基本理念,侧重规制药师的义务及责任。英国、美国的药师法则体现了控权论的基本理念,侧重规制药师管理主体的实体权力和行政程序。我国药师法应采取平衡论的基本理念,并在该基本理念的指导下构建我国药师法的基本制度,包括注重药学服务的角色定位并落脚于健康权保障、注重协调职称药师和执业药师的关系、注重药师权利和义务的统一、注重行政管理主体和相对人职权和责任的统一。

From the perspective of legislation practice of overseas pharmacists,the pharmacist law in Japan and Taiwan Region of China embodies the basic idea of management theory,focusing on the obligations and responsibilities of pharmacists.While the pharmacist law in United Kingdom and United States embodies the basic idea of power control theory,focusing on regulating the substantive power and administrative procedures of the subject of pharmacist management.China's pharmacist law should adopt the basic concept of balance theory,and under the guidance of this basic concept,we should construct the basic system of China's pharmacist law,including emphasizing the role orientation of pharmaceutical care and protecting the right to health,focusing on the coordination of the relationship between the title pharmacist and licensed pharmacist,the rights and obligations of pharmacists,and the administrative management of the main body and the relative person of the unity of authority and responsibility.
