摘要
近期网络课程行业蓬勃发展,大众对教育的需求剧增,网络课程的著作权问题集中在著作权归属认定难和合理使用的适用问题。网络课程可以构成口述作品、电影作品或类电作品、录像制品等,不同的类型的作品涉及到的权利人繁杂,进而网络课程的著作权归属认定难;网络课程作为新兴事物与合理使用的制度适用产生矛盾。结合创作共用许可证与区块链技术,明晰网络课程的权利归属,降低维权成本;可借鉴TEACH法案,扩大解释“学校课堂教学”范围,明确合理使用制度适用于网络课程,确定适用范围以及注意事项范围。
Recently,the online course industry is booming,and the public's demand for education has increased dramatically.The copyright issues of online courses are focused on the application of difficult and reasonable use of copyright attribution.Online courses can be oral works,movie works or electro-like works,video products,etc.Different types of works involve complicated rights holders,and it is difficult to confirm the ownership of online courses;online courses as a new thing are in contradiction with the application of reasonable use system.Combining the creation sharing license and blockchain technology,clarify the attribution of online courses and reduce the cost of rights protection;learn from the TEACH Act,expand the scope of classroom teaching,clarify that the reasonable use system applies to online courses,confirm the scope of application and precautions range.
