我国现行法律法规中附录情况的语言学考察

Investigation on the Appendix Status of Current Laws and Regulations in China

文章在对我国现行的200部国家法律法规和200部地方法规进行考察的基础上,总结出我国现行法律法规在附录设置上存在的有实有名、有实无名和无实无名等三种情况。从内容上看,附录有四种类型:法律法规的过程性说明或与其相关的其他法律法规的条文;法律法规所涉及的相关图案、项目表、价目表、计算公式、名物目录等;法律法规所涉及的相关名物、事项的说明;法律法规所涉及的重要名物、事项的规范。在归纳了现行法律法规附录所存在问题的基础上,从立法技术规范的视角提出了名称应统一为"附录",附录应立有规范的标题等七条建议。

Based on the investigation of current 200 national laws and regulations and 200 local laws and regulations in China,this paper summarizes three situations of appendix setting in the existing laws and regulations:reality with name,reality but nameless,and non-reality without name.From the content point of view,appendix can be classified into four types:the appendix of process description or the relevant legal provision of other laws and regulations;related design,project list,price list,calculation formula,object name and description directory,etc.Relative object and its description and item exposition of laws and regulations;important object and its description and specification of matters involved in laws and regulations.On the basis of summarizing the problems existing in the appendix of current laws and regulations,this paper puts forward seven suggestions from the perspective of legislative technical norms,such as the name should be unified as“appendix”,and the appendix should have a normative title.
