侦查讯问中嫌疑人心理变化过程研究

Research on the Psychological Change of Suspects in Investigation and Interrogation

侦查讯问中嫌疑人的心理变化具有规律性,依据嫌疑人的行为特征可以将侦查讯问分为前期、中期和后期三个阶段。在侦查讯问前期主导嫌疑人的心理状态主要有抵触心理、畏罪心理、试探心理和侥幸心理,在侦查讯问中期主要有虚荣心理、恐慌心理、戒备心理和应激心理,在侦查讯问后期主要有悲观心理、动摇心理、无意识心理和供述心理。通过对每一种主导性心理状态在认知、情绪和意志三方面的分析,侦查人员可以对嫌疑人的行为进行解释、控制和预测,采取针对性的讯问策略,讯问策略可以从认知引导、情绪控制和增强供述意志三方面进行,从而促进嫌疑人如实供述,达到侦查讯问的目的。

The psychological changes of the suspects in the investigation and interrogation are regular.Based on the behavior characteristics of the suspects,the investigation and interrogation can be divided into three stages:early stage,middle stage and late stage.In the early stage of investigation and interrogation,the psychological state of the leading suspects mainly includes the psychology of resistance,fear of crime,temptation and fluke;in the middle stage of investigation and interrogation,they have the psychology of vanity,panic,vigilance and stress;in the later stage,there are mainly the psychology of pessimism,wavering,unconsciousness and confession.On the basis of analyzing each kind of dominant psychological state in terms of the cognition,emotion and will,investigators can explain,control and predict the suspect’s behavior,adopting the strategy of questioning strategy mainly from cognitive guidance,emotional control and enhancing the confession will,so as to promote the suspect truthfully confession and achieve the purpose of investigation and interrogation.
