风险社会视域下电信网络诈骗犯罪治理路径研究

Research on the Governance Path of Telecom Network Fraud Crime from the Perspective of Risk Society

互联网技术的发展增加了各类网络犯罪出现的风险,电信网络诈骗犯罪是其中的典型表现。在网络技术和风险社会的交织下催生电信网络诈骗犯罪的风险源主要有技术源与制度源两方面,电信网络诈骗犯罪隐匿化、链条化、集团化、智能化、国际化、犯罪危害前移的特点也带来了潜在性、复杂性、不可控性、全球性和扩大性的风险,这给公民的财产安全带来了巨大威胁。公安机关应改进侦查取证方式,建立国内、国际警务合作机制,加强情报信息研判,重点地区重点治理,由点及面深挖上游犯罪,同时也要加强行业监管,注重被害的事前预防教育,实现对电信网络诈骗犯罪的综合治理。

The development of Internet technology increases the risk of various kinds of network crimes, among which telecom network fraud crime is a typical one. The risk courses of telecom network fraud precipitated by the combination of the network technology and the risk society include a technology source and an institutional one. The risks of telecom network fraud are latent, complex, uncontrollable, and increasing all over the world as network fraud is more and more invisible, systematic, organized, intelligent, globalized and its harm can be seen immediately, posing great threat to the safety of citizen’s property. The public security organs should improve the methods of investigation and evidence collection, establish a domestic and international police cooperation mechanism, strengthen the research and judgment of intelligence and information, focus on the governance of key areas, take a specific-to-general approach to uproot such crime. At the same time, efforts should be made to strengthen the supervision of various industries, pay attention to the crime prevention education in advance, in order to achieve the comprehensive governance of telecom network fraud.
