宪法实施视域中宪法援引典型案例分析

随着宪法实施被赋予更高的要求和价值,宪法援引成为推进宪法实施的有效路径。宪法援引在司法实践中既是客观存在的,也有其合理之处。通过检索分析中国裁判文书网中某省进行宪法援引的裁判文书,发现其历年援引宪法的文书数量、援引主体、援引法院和援引内容体现了宪法援引在司法实践中的现状及其蕴含的价值。宪法援引的确有助于提高公民的宪法意识,有利于提高裁判文书的专业水平以及法律逻辑的严谨性和说理性,使宪法的最高法律效力转化为可靠的司法现实。同时宪法援引中存在的缺乏制度保障等问题也不可忽视,需对宪法援引做出妥善的制度安排,以便其更好地发挥积极作用。

As the implementation of the Constitution is endowed with higher requirements and values,Constitution citation has become an effective way to promote the implementation of the Constitution.Constitution citation exists objectively in judicial practice,which has its rationality.By searching and analyzing the judicial documents cited by the Constitution of a province in the judicial documents network,the number,subject,court and content of the documents cited by the Constitution over the years reflect the current situation and the value of Constitutional citation in judicial practice in China.It is helpful to improve consciousness of citizens of the Constitution,the professional level of judicial documents,the preciseness and reasoning of legal logic,and the transformation of the highest legal effect of the Constitution into a reliable judicial reality.At the same time,the lack of institutional guarantee in the Constitution citation cannot be ignored.It is necessary to make proper institutional arrangements for the Constitution citation in order to play a positive role.
