摘要
宅基地使用权抵押对农村经济发展和农民融资增收具有重要意义,但现行法律囿于宅基地的保障功能而限制其抵押。“三权分置”的改革政策为宅基地使用权赋予了新的内涵和属性,能够破除其抵押流转障碍。为保障农民住房财产权,适度放活宅基地使用权,应放开宅基地使用权抵押,并对抵押主体进行明确,对宅基地作为抵押物单独抵押、期限限制等进行制度设计,进一步完善抵押程序和其他配套制度。
The mortgage of the right to use homestead is of great significance to the development of rural economy and the increase of farmers’financing.However,the law of our country limits the mortgage of the right to use homestead in order to protect the housing rights and interests of farmers.The reform strategy of"three-right separation"makes the right to use homestead have new connotation and attribute.In order to protect the housing property rights of farmers,the right to use homesteads should be appropriately released,and the mortgage of the right to use homesteads should be liberalized.Mortgage entities should be clarified,and the housing sites should be mortgaged separately as collateral,and deadlines should be limited,and the mortgage procedures and other supporting systems should be further improved.
