黄河上游段特殊生态环境问题及协同治理的法律路径

The Special Ecological Environment Problems in the Upper Reaches of the Yellow River and the Legal Path for Coordinated Governance

黄河上游段自河源起,至内蒙古自治区托克托县的河口镇止。黄河上游段是黄河治理的第一站,实现上游段的善治是确保黄河安澜的基础。目前,在黄河上游段治理过程中存在治理主体单一化、治理客体复杂、治理方式缺乏稳定性和协调性的协同治理困境,不能针对上游段存在的洪水问题、特殊污染问题以及水源地生态破坏特殊生态环境问题进行有效解决。建议完善协同治理法律路径,通过创新生态环境治理主体的协同路径、建立流域内生态环境问题协同沟通机制、出台“黄河生态环境保护法”以巩固协同治理制度化基础,针对黄河上游段特殊生态环境问题提出有针对性的解决措施,保障黄河岁岁安澜。

The upper reaches of the Yellow River start from the source of the river and end in Hekou town,Tuoketuo county,Inner Mongolia Autonomous Region.As the first stop for the governance of the Yellow River,the good governance of the upper reaches is the basis for ensuring the whole security of the Yellow River.Currently,in the process of the governance in the upper reaches of the Yellow River,there exist some predicaments such as the single governance subject,the complex governance object,governance methods that are lack of stability and coordination.So,it is difficult to effectively solve the problems in the upper reaches,such as the flood,the special pollution,the ecological damage in the water source,and special ecological environment etc.It is suggested to complete the legal path for coordinated governance.Through the innovation of coordinated path for the governance subjects of ecological environment,the establishment of coordinated communication mechanism for the ecological environment,the issuance of Protection Law for the Ecological Environment of the Yellow River,we can strengthen the basis for co ordinated governance system,and aiming at the special ecological environment problems in the upper reaches of the Yellow River,propose targeted measures to guarantee the security of the Yellow River every year.
