糖尿病中药制剂的知识产权分析

Intellectual Property Analysis of Chinese Medicine Preparations for Diabetes

目的简要介绍治疗糖尿病的新型中药制剂,重点阐述其知识产权保护的突出问题,为从事知识产权保护研究的工作者们提供借鉴作用。方法通过相关文献和国家知识产权局专利数据库检索,对申请专利的数量、类型、成分、申请机构和各省份的专利申请量做统计分析。结果糖尿病中药制剂的专利申请量在糖尿病中药药物中所占比例仅为0.143,专利来源最多的省市为北京市,其中北京艺信堂医药研究所申请的专利数最多,达79件。同时,申请糖尿病中药制剂的专利全部为国家发明专利,绝大多数专利的药用配方中含有丹参。结论我国申请治疗糖尿病中药制剂的专利数量呈下降趋势,企业对糖尿病中药制剂的新药研发相对缓慢,同时国内普遍对中药制剂的知识产权保护意识不强。

OBJECTIVE To briefly introduce a new type of Chinese medicine for the treatment of diabetes,and to focus on the outstanding problems of its intellectual property protection,for providing workers who engaged in intellectual property protection research with a reference. METHODS Through searching related documents and the patent database of the State Intellectual Property Office,statistical analysis was made on the numbers,types,compositions,application institutions and patent applications of each province.RESULTS The number of patent applications for diabetic Chinese medicinal preparations accounted for only 0. 143 in diabetic Chinese medicinal drugs. The province with the most patent sources was Beijing. Among them,Beijing Yixintang Medical Research Institute applied for the most,reaching 79. At the same time,all patents had applied for Chinese medicine preparations for diabetes which were national invention patents. And most of the patented medicinal formulas contained Danshen. CONCLUSION The patent application number of Chinese medicine preparations for the treatment of diabetes have shown a downward trend. Enterprises in the development of new medicines for Chinese medicine preparations for diabetes have been relatively slow. At the same time,the awareness of intellectual property protection of Chinese medicine preparations is generally not high in China.
