摘要
教育行政执法中的裁量基准,是指教育行政机关以判断选择的标准化方式,将教育立法授予的裁量权限予以具体化的过程。我国教育行政执法中裁量基准设定的地方经验表明,“情节细化”和“效果格化”是裁量基准的主要技术构造。为提升裁量基准的品质、保障裁量基准的适用效果,教育行政执法中裁量基准的完善路径包括:拓展裁量基准的类型;裁量基准设定的相对义务化;理顺裁量基准设定的主体关系;裁量基准设定程序适当引入公众参与;保证裁量基准的灵活性等。
The discretion benchmark in the law enforcement of educational administration refers to the process that the educational administrative organ concretizes the discretionary power granted by the educational legislation in the standardized way of judgment and selection.The local experience of setting discretion benchmark in China s law enforcement of educational administration shows that“Fact Concretization”and“Effect Realization”are the main technical structures of discretion benchmark.To improve the quality of discretion benchmark and ensure the application effect of discretion benchmark,the improvement path of discretion benchmark in law enforcement of educational administration includes:the extension of the types of discretion benchmark,the obligatory requirement of discretion benchmark,the clarification of the subject relationship of discretion benchmark setting,the limited public participation in the confirmation process of discretion benchmark and the guarantee of the flexibility of discretion benchmark.
