非物质文化遗产传承人智力成果的知识产权保护路径——以苏州现状为蓝本

On the IPR Protection Path of the Intellectual Creation by the Inheritors of Intangible Cultural Heritage: Taking Current Suzhou as an Example

非物质文化遗产的良性传承与发展,需要将传统文化与现代需求完美结合,而非物质文化遗产传承人在兼顾遗产"传统保守"与"创新传承"两个维度中发挥着举足轻重的作用。本文以苏州现有国家、省、市三级非遗项目和传承人为蓝本,基于非物质文化遗产传承面临问题的实证分析,提出"分类施策、共合保护"模式,即鼓励由传承人为代表的从事非物质文化遗产传承的群体在各领域创新注入新时代内涵,由政府统领各研究机构、社会组织和企业共同参与,对传承人在非物质文化遗产传承中作出的创新性智力成果给予知识产权保护,以期进一步激发非物质文化遗产传承群体的创新活力,使非物质文化遗产在提升中发展,在发展中传承。

The beneficial inheritance and development of intangible cultural heritage requires the perfect combination of traditional culture and modern needs, while inheritors play a pivotal role in both aspects of "tradition conservation" and "innovative inheritance". Based on the existing national, provincial and municipal intangible heritage projects and inheritors in Suzhou, and also on the empirical analysis of the problems faced by inheritance, the paper proposes a model of "classified policy implementation and joint protection". The model encourages groups represented by inheritors engaged in the inheritance of intangible cultural heritage to innovate and inject new era spirit in various fields;the government to lead various research institutions, social organizations and enterprises to participate the undertakings;to protect the innovative intellectual achievements made by the inheritors in the process of inheritance of intangible cultural heritage;and to further stimulate the innovation capability of the inheritors, so that the intangible cultural heritage can developed in ascension and inherit through development.
