摘要
"一带一路"倡议为我国对外劳务合作提供了新的发展机会,将会带动我国对外投资规模和劳务输出人员的新增长。但同时我们也应清醒地看到因"一带一路"沿线国家制度体制的不同所可能存在的对外劳务合作方面的法律问题。在这种情况下,扩大双边劳务合作协定的签订国家数量,熟悉合作国的对外劳务合作法律和规定,进一步完善我国对外劳务合作的立法,要求企业在对外劳务合作方面规范管理,不能忽视境外劳务人员的权利保障,进而可提高我国对外劳务合作抗法律风险的能力。
The Belt and Road Initiative(BRI)brings a variety of development opportunities for international Chinese labor cooperation,which will drive the new growth of international investment scale and labor export personnel.However,we should also be aware of the legal problems that may exist in international labor cooperation due to the differences in the systems of countries along the“Belt and Road”.Under this circumstance,in order to further improve our country’s ability to resist legal risks in international labor cooperation,some preventive measuresshould be taken in expanding the number of countries that have signed bilateral labor cooperation agreements,being familiar with the international labor cooperation laws and regulations of the partner countries,and further improving international Chinese labor cooperation legislation,requiring enterprises to regulate the management of international labor cooperation,attaching importance to the protection of the rights of international labor personnel.
