为了回应执政党提出的政治命题,修宪者将中国共产党的领导规定在国家根本制度条款中,这使得党的领导与社会主义的关系有了更加丰富的宪法意涵。在国家根本制度条款的规范结构中,中国共产党的领导以“中国特色社会主义最本质的特征”的形式呈现,而中国特色社会主义是社会主义初级阶段在中国的具体样态,这极大地拓展了中国共产党在社会主义制度中的作用空间,中国共产党的领导由此可以纳入社会主义的各项具体制度中。把中国特色社会主义与中国共产党的领导一并写入条文,在增强社会主义制度之包容性的同时,也确定了中国特色社会主义事业必须恪守的政治原则。由于中国共产党的领导成为社会主义制度的核心要素,“破坏社会主义制度”的禁止性规定亦可用于规制破坏党的领导的行为。

In response to the political decision,the framers of the Constitution stipulate"the leadership of the CPC"in the Constitution,which in this process has enriched the Constitutional implication of the relationship between"the leadership of the CPC"and"the socialism".Based on the structure of Paragraph 2 of Article 1,the leadership of the CPC is the most essential feature of socialism with Chinese characteristics,and the socialism with Chinese characteristics is the specific representation of socialism at the initial stage.This system design greatly expands the role of the CPC in socialist system space.The inclusion of"socialism with Chinese characteristics"and"the leadership of the CPC"in the clause of the basic system not only enhances the inclusiveness of the socialist system,but also defines the political principles that must be observed in the cause of socialism with Chinese characteristics.Since the"the leadership of the CPC"is the core element of the"socialist system",the prohibitive stipulation of destroying the socialist system can also be applied to the behavior of destroying the"the leadership of the CPC".
