摘要
作者权体系与版权体系有着诸多不同,二者的认识分歧也体现在对“体育赛事直播画面是否属于作品”这一问题的不同认识之中。这一争论的核心在于,赛事直播画面是否具有独创性。作者权体系与版权体系在认定作品时采用了不同的独创性标准,前者以独创性的“高低”为标准区分作品与非作品,后者则以“有无”独创性为标准。标准的差异导致了对直播画面著作权性的不同认识。与作者权体系相比,版权体系更符合著作权制度的初衷和发展规律,而从版权体系的原理出发,宜将体育赛事直播画面认定为作品。
There are many differences between authorship system and copyright system,which are also reflected in the question whether the live broadcast of the sports event is a work.The core of this debate lies in whether the live broadcast of the event is original.Authorship system and copyright system use different originality stan⁃dards when identifying works.The former distinguishes works and non-works with the standard that if there is originality in it,while the latter uses the standard that if the originality is high enough.Differences in standards lead to different understanding of live pictures copyrightability.Compared with authorship system,copyright sys⁃tem matches the original intention and law of copyright better.According to the principles of the copyright sys⁃tem,we should identify the live broadcast of the sports event as a work.
