黑恶势力是社会发展过程中的不良现象,对人民合法权益和社会秩序造成了破坏。黑恶势力存在屡禁不止的现象,产生是因为对黑恶势力进行打击处置的过程中存在着手段上的缺失,没有做到早打、打小的要求;对有关参与人员的惩治过程中存在法律手段上的不足,没有起到应有的司法效果。刑法中的保安处分可以弥补刑法打击手段中的不足部分,对潜在的危险行为和轻微的不法现象进行适当处置,从而达到惩治黑恶势力的良好效果。

The black evil force is a bad phenomenon in the process of social development.It has disrupted the legitimate rights and interests of the people and public order.The reasons for the persist existence of black evil force go as the following:lacking strict measures for fi ghting and controlling,failing to give earlier blow and to crush a vice in the bud,having defi ciencies in legal means for punishing relevant participants,being unable to play the due judicial effect.The security punishment in the criminal law can make up for the defi ciency in striking measures.In order to achieve good effects of punishing the black evil force,properly punishments are needed for dealing with the potentially dangerous behaviors and minor illegal phenomena.
