论刑事法庭余留机制对国际罪行的追诉——以卢旺达刑庭卡布加案为切入点

On the prosecution of international crimes by the residual mechanism for criminal tribunals——Taking the Kabuga Case at the criminal tribunal of Rwanda as an entry point

卢旺达大屠杀中的犯罪嫌疑人之一弗利西安·卡布加在逃亡26年被逮捕后,以种族灭绝罪和危害人类罪被检察官起诉,将会接受卢旺达国际刑事法庭余留机制的制裁。本案仍在诉讼时效内,余留机制对卡布加具有属人、属地、属时、属物四方面的管辖权。根据卡布加的犯案事实,从一般性要件、物质要件和心理要件三个层面分析,其构成种族灭绝罪和危害人类罪的可能性极大。如果能够顺利结案,本案将是联合国安理会维护世界和平与安全的一次成功实践。

One of the suspects in the Rwandan massacre,Félicien Kabuga,was arrested after 26 years on the run and indicted by the prosecutor for genocide and crimes against humanity,and will be subject to sanctions by the residual mechanism of the International Criminal Tribunal for Rwanda.The case is still within the statute of limitations,and the mechanism has jurisdiction over Kabuga ratione personae,ratione loci,ratione temporis,and ratione materiae.Based on the facts of Kabuga′s crime,it is highly probable that he constituted genocide and crimes against humanity based on the analysis of the three dimensions of general,material and mental elements.If the case can be successfully concluded,this case will be a successful practice of the UN Security Council in maintaining world peace and security.
