“三权分置”视域下土地承包经营权流转法律问题探析

Research on Legal Issues of the Circulation of Contractual Rights of Land in the Context of “Three Powers Separation”

“三权分置”是中国农村土地产权变革的产物,其符合社会发展的需要。在“三权分置”政策推动下农村土地流转规模扩大,既有利于农村土地资源的优化配置,又能增加农民收入。但是在农村土地流转中也并存一些问题,不解决好现存的诸多问题,就会制约土地流转的快速发展。文章主要针对我国“三权分置”背景下土地承包经营权流转过程中存在的问题进行分析,提出合理的建议和对策,以实现我国农村土地规范流转和有效利用。

The policy of“three powers separation”is a product of the reform of China's rural land property rights,which meets the needs of social development.The expansion of rural land transfer under the promotion of the‘three powers separation'policy will not only help optimize the allocation of rural land resources,but also increase farmers'income.However,there are also some problems in rural land transfer.Failure to solve many existing problems will restrict the rapid development of land transfer.This paper mainly analyzes the problems existing in the transfer process of the circulation of contractual rights of land under the background of the country's“three powers separation”,puts forward reasonable suggestions and countermeasures to realize the standardized transfer and development of rural land in my country.
