中国化马克思主义理论对我国各领域中存在的问题具有普遍的指导意义。我国专利制度在发展过程中形成了专利权棘轮式的单向扩张,并引发了诸如专利申请爆炸、专利权滥用、专利竞赛、专利丛林、不当专利申请等问题。专利权从防御性策略工具逐渐演变为限制竞争和创新的“核武器”。专利制度存在背离其促进技术创新、商业发展和社会进步等目标的现象。马克思主义异化理论、矛盾理论、生产力和生产关系理论以及唯物主义历史观对矫正我国专利制度问题具有科学的指导作用。

The sinicization of Marxist theory is of universal guiding significance to the problems existing in various fields of our country.During the process of development of China’s patent system,Patent rights show a ratchet-wheel-type one-way expansion state.As a result,the patent files explosion,the patent abuse and patent race,patent jungle,improper patent application and so on were produced.From defensive strategic tools,patent rights are evolving into nuclear weapons and limiting competition and innovation.The patent system gradually deviates from its value goal of promoting technological innovation,commercial development and social progress.Marxism alienation theory,contradiction theory,the productive forces and the production relations theory and materialism view of history can guide China’s patent system reform.
