贯彻习近平生态文明思想与法治思想的立法实践——《长江保护法》解读

Major legislation practice to implement Xi Jinping Thought on Ecological Civilization and Xi Jinping Thought on Rule of Law: interpreting Yangtze River Protection Law

《长江保护法》经十三届全国人大常委会第二十四次会议通过,于2021年3月1日起正式实施。从贯彻习近平生态文明思想与法治思想的重大立法实践的角度出发,对出台《长江保护法》的立法背景进行了思考,系统分析了《长江保护法》的特点,结合水法律法规梳理,对新老法律之间的水法律制度调整内容进行了比较分析。针对长江流域目前存在的多重问题,从加强系统治理、强化治理体系和治理能力现代化、推进绿色发展等方面阐述了《长江保护法》所发挥的法治保障作用。

Yangtze River Protection Law, passed at the 24 th Standing Committee Session of the 13 th National People′s Congress, took effect on March 1,2021.We analyze the legislation background of the Yangtze River Protection Law from the perspective of implementing Xi Jinping Thought on Ecological Civilization and Xi Jinping Thought on Rule of Law.We systematically analyze the features of Yangtze River Protection Law and through sorting out other water related laws, we introduce the adjustment contents between other water laws and the Yangtze River Protection Law.Aiming at the faced problems in Yangtze River Basin, we demonstrate guarantee effect on rule of law by the Yangtze River Protection Law from aspects of strengthening systematic regulation, intensifying modernization of governance system and governance ability, promoting green development of Yangtze River Basin.
