摘要
"航空器上或者上、下航空器的过程中"这一重要术语涉及国际航空旅客运输赔偿,但该术语没有在1999年《蒙特利尔公约》里被定义和解释,这会影响到法院对该术语的判定从而影响旅客赔偿。本文详细阐述了司法实践中法院对该术语的判定方法,即"位置要素决定说"和"代伊模式",通过对比分析以及案例分析的方法,得出前者判断方式单一、不利于旅客权益保护,而后者综合多种因素进行判断可以更好地保护旅客权益,所以对该术语的判定应采用后一方法的结论。另外,采用"代伊模式"对我国司法实践具有重要的借鉴意义。
The term embarking of dis-embarking relates to international air passenger transport compensation,but the term is not defined and explained in the 1999 Montreal Convention,which affects the court’s determination of the term.Thereby affecting passenger compensation.This paper elaborates on the method of judging the term in the judicial practice,‘location test’and‘Day-Evangelions test’,By comparing and analyzing the two methods the conclusion that the former has a single judgment method and is not conducive to the protection of passengers’rights.The latter can better protect passengers’rights and interests by combining multiple factors.Therefore,the latter method should be judged by the latter method.in conclusion.In addition,the use of the‘Day-Evangelions test’has important reference significance for Chinese judicial practice.
