放管服背景下的我国通用航空法规体系解读与重构

近年来,我国的通用航空业发展迅速,但由于我国基础较差、起步较晚等原因,导致出现了许多制约我国通航发展的因素,重要原因之一就是我国没有建立专门针对通航的完善法规标准体系。文章首先对我国当前通用航空放管服背景下的法规标准体系重构进行需求分析;然后结合欧美通航发达国家法规标准体系对比分析,对我国通用航空法规体系从法律、法规以及规章三个维度进行梳理解读;最后从组织体系保障、体系重构针对灵活性、无人机法制以及差异分类管理四个层面提出我国通用航空法规体系重构实施路径。

In recent years,china’s general aviation industry has developed rapidly,but due to our country’s poor foundation and late start,there have been many factors restricting the development of China’s general aviation.One of the important reasons is that China has not established a perfection.system of regulations and standards for general aviation.Firstly,we analyze the needs for the restructuring of the regulatory and standard system under the background of China's current general aviation decentralization service.Secondly,we combine the comparative analysis of the regulatory and standard systems of developed countries in Europe and the United States,and analyze the general aviation regulatory system in our country from the three dimensions of laws,regulations and rules.Finally,we put forward the implementation path of my country’s general aviation regulatory system restructuring from four levels:organizational system guarantee,system restructuring,flexibility,UAV legal system,and differential classification management.
