从软法的作用与影响看《外空活动长期可持续性(LTS)准则》的执行问题

Implementation of Guidelines for the Long-term Sustainability of Outer Space Activities:From the Perspective of the Function and Impact of Soft Law

当前,外空领域软法规则制订极为活跃。《外空活动长期可持续性(LTS)准则》历经8年艰苦谈判达成,是近年来联合国外空委平台最重要的规则制订成果,准则内容丰富,涵盖面广,影响深远。本文立足于近年来外空规则制订的大趋势,对LTS准则的性质和特点进行分析,并深入解读LTS准则作为软法对于外空法的作用,研判执行LTS准则的紧迫性和必要性,并在此基础上提出可操作性建议。

Nowadays,soft law rulemaking in outer space is active and fruitful.Guidelines for the long-term sustainability of outer space,the outcome of eight years\tough negotiation,is the most important rulemaking document of the United Nations Committee on the Peaceful Uses of Outer Space in recent years.The Guidelines are overarching and of great significance.Based on the international rulemaking background in outer space,this article describes the nature and characteristic of the Guidelines.It also analyses the function of the Guidelines as soft law in the framework of international space law.This article observes that there is urgency and necessity to implement the Guidelines.In the end,some practical recommendations on implementing the Guidelines are put forward.
