“杀猪盘”式网络诈骗是指行为人以“恋爱”“交友”等手段为幌子骗取被害人信任后,以各种理由诱导被害人在事先控制的虚假网站、平台进行赌博、投资,骗取被害人钱财的一种新型网络犯罪行为。近年来,“杀猪盘”式网络诈骗案件呈高发态势,业已成为电信网络诈骗犯罪的主要方式之一。因该犯罪具有犯罪行为多样、犯罪手段隐蔽、犯罪时间持久等特点,公安机关在打击和防范方面成效并不明显。犯罪脚本理论是犯罪学理论研究的最新成果,其通过列出犯罪过程中的所有步骤,为预防犯罪提供了多点干预。破坏脚本中的任何一点都会改变常规的行为顺序,在最好的情况下,犯罪可能会被终止。为提升对“杀猪盘”式网络诈骗犯罪的治理效果,公安机关尝试结合犯罪脚本理论予以犯罪预防具有重要的现实意义。

“Pig-butchering”cyber fraud refers to a new type of cyber crime in which perpetrators win the trust of victims through a romantic relationship such as“love”,“making friends”before tricking them into a gambling and investing on false websites and platforms controlled in advance to defraud money.Recent years have witnessed frequent occurrence of“pig-butchering”cyber frauds,which has become one of the main means of telecom cyber fraud.Public security organs have no obvious effect in cracking down and preventing this type of crime due to the characteristics of various criminal acts,hidden means and long duration of crimes,etc.Script crime theory is the latest achievement of theoretical research in the field of criminology,which provides multi-point intervention for crime prevention by listing all of the steps in the process of crime.Breaking any point in the script can change the normal sequence of actions,and in the best case,crime may be terminated.In order to improve the effect of“pig-butchering”cyber fraud crime,it is of great practical significance for public security organs to try to prevent crimes combined with crime script theory.
