Countermeasures and Suggestions on Regulating Illegal Sand Mining in the Yangtze River Basin

长江流域生态环境资源保护法律制度的完善是流域生态文明建设的重要内容。其中非法采砂不仅严重危害了航道安全、造成国家矿产资源巨大损失,而且严重制约了长江流域的经济发展,对流域的生态环境造成极大的破坏。经过考察,本文对长江流域非法采砂的现状及其特征进行分析梳理,探究长江流域非法采砂司法实践中的困境,并对此提出相关的法制构想,力图破解我国长江流域非法采砂司法实践中的难题,为完善长江流域生态环境资源保护的法律制度贡献一份力量。

The improvement of the legal system for the protection of ecological environment and resources in the Yangtze River Basin is an important part of the construction of ecological civilization in the Yangtze River Basin.Among them,illegal sand mining not only seriously endangers the safety of navigation channels and causes huge losses of national mineral resources,but also seriously restricts the economic development of the Yangtze River Basin and causes great damage to the ecological environment of the basin.After investigation,this paper analyzes the current situation and characteristics of illegal sand mining in the Yangtze River Basin,explores the difficulties in the judicial practice of illegal sand mining in the Yangtze River Basin,and puts forward relevant legal ideas,trying to solve the problems in the judicial practice of illegal sand mining in the Yangtze River Basin,and contribute to the improvement of the legal system of ecological environment and resources protection in the Yangtze River Basin.
