检察监督案件化办理机制探索--以被告人涉案财物处置为监督视角

Exploration of Case Handling Mechanism of Procuratorial Supervision--Taking the Disposal of the Property Involved in the Case as the Supervision Perspective

当前,我国司法实践中对于刑事诉讼涉案财物,包括被告人被扣押、查封、冻结的合法财产的保管、处置活动出现诸多不规范之处,一定程度上损害了公民财产权和司法公信力。然而,囿于宏观上立法之缺失、微观上机制之缺位,检察机关对于被告人涉案财物处置的监督工作尚处于探索模式。鉴于此,应当转变监督理念,构建案件化办理的工作机制,完善程序设计及保障机制,健全检察机关开展相关监督工作的法定程序。

In the current judicial practice of our country,there are many irregularities in the custody and disposal of the property involved in criminal proceedings,including the legal property of the defendant that is seized,sealed and frozen,which to a certain extent damages the property rights of citizens and judicial credibility.However,due to the lack of legislation at the macro level and the absence of mechanism at the micro level,the supervision work of procuratorial organs for the disposal of the property involved in the case is still in the exploration mode.In view of this,we should change the concept of supervision,construct the working mechanism of case handling,perfect the procedure design and guarantee mechanism,and perfect the legal procedure of procuratorial organs to carry out the relevant supervision work.
