社会主义核心价值观“入法入规”文本研究——以299部法律法规为分析样本

社会主义核心价值观“入法入规”是“把社会主义核心价值观融入法治建设”的具体举措。近年来,在文本中包含“社会主义核心价值观”的法律法规数量快速增加,在法条中写入“社会主义核心价值观”成为“入法入规”的重要表现形式之一。但“写入”并不等同于“融入”,简单地将核心价值观写入法律法规文本,既无法有效发挥核心价值观的价值引领作用,更可能在某些情况下损害法律体系自身的规范性、稳定性。作为具有重要价值引领作用的政治话语,核心价值观入法入规应体现在其对立法全过程的宏观价值指引及对立法领域的优先选择上,从而实现价值观对立法的无形引导。

“Integrating socialist core values into laws and regulations”is a specific measure of“integrating socialist core values into the rule of law”.In recent years,the number of laws and regulations containing“socialist core values”in the text has increased rapidly,and writing socialist core values into laws regulations has become one of the important expressions of“integrating socialist core values into laws and regulations”.However,writing is not equivalent to integrating.Simply writing the core values into the text of laws and regulations will not effectively play the role of leading the values of the core values,and is more likely to damage the legal system’s own normative stability.As a political discourse with an important value leading role,the core values should be reflected in the macro value guidance of the entire process of legislation and the priority choice in the legislative field,so as to realize the invisible guidance of values to legislation.
