专利无效程序中对比文件检索策略研究——从专利引文角度探析

Study on the Retrieval Strategy of Prior Arts in Patent Invalidation Procedure—Analysis from the Perspective of Patent Citation

本文梳理了实践中专利无效检索一般采用的流程,提出了仅依赖一般的构建检索式在海量信息中进行检索的时间和成本的局限性。在对专利无效程序中的对比文件进行说明和界定的基础上,进一步探讨了通过引文分析进行专利无效检索的理论基础和实务操作中的合理性,同时指出专利无效检索过程中需要注意的问题。最后以具体案例说明引文分析对专利无效检索所产生的直接效果。

This article sorts out the general process of patent invalidation search in practice,and proposes the limitation of time and cost for searching in massive information only by relying on general construction search strategy.Based on explaining and defining the prior arts in the patent invalidation procedure,it further explores the theoretical basis of patent invalidation search through citation analysis and the rationality of practical operation,and points out the problems that need attention in the process of patent invalidation search.Finally,a specific case is used to illustrate the direct effects of citation analysis on patent invalidation searches.
