压覆矿产管理与占用补偿问题研究

Research on the Management and Occupation Compensation of Mineral Resources Overlaid with Construction Projects

当前我国压覆矿产管理存在矿产压覆报告备案涉及矿种众多,压覆矿产司法纠纷呈逐年上升,压覆矿产资源管理法理不清晰、经济社会效益对比机制不健全,部分压覆导致剩余范围不能开发的补偿等问题。针对这些问题建议:加强压覆矿产资源行政法规的顶层制度供给,夯实压覆矿产管理基础支撑体系;补充完善压覆重要矿产的矿种类别;从法理上坚持补偿压覆矿产的实际损失,按探矿权、采矿权相关情形分类补偿;研究出台相应的技术与规程作支撑。

At present,there are many problems in the management of overlaid mineral resources in China,such as many mineral species involved in the filing of mineral overlaid reports,judicial disputes over overlaid minerals are increasing year by year,the jurisprudence of overlaid mineral resources management is not clear,the mechanism of comparing economic and social benefits is not complete,and the compensation for the undeveloped remaining scope caused by partial overlaying.In view of these problems,the paper puts forward the following suggestions:strengthen the top-level system supply of administrative regulations on overlaid mineral resources,and solidify the primary support system for overlaid mineral management;supplement and optimize the categories of mineral species overlaid with essential minerals;insist on compensating the actual loss of overlaid minerals from the legal point of view,and classify the compensation according to the relevant situations of prospecting rights and mining rights;study and introduce corresponding technology and regulations for support.
