被遗忘权视角下档案利用的价值矛盾、原则折中与进路分析

Analysis of Value Contradiction,Principle Compromise and Approaches of Archives Utilization from the Perspective of the Right to Be Forgotten

网络空间领域中,“被遗忘”的需求日渐凸显,通过解构档案价值与被遗忘权之间在记忆、伦理、数据、法制等视角下的取向矛盾,阐析被遗忘权行使于档案利用过程中的等效代换、限度修改、数据保护及授权征求四类折中原则,依循法规确权、主体分域、数据分层、安全防护四方面提出可行路径,为档案利用工作中纳入被遗忘权理念寻求可调空间。

In the field of cyberspace,the demand for'forgotten'has become increasingly prominent.By deconstructing the contradiction between the value of Archives and the right to be forgotten from the perspectives of memory,ethics,data,and legal,then propose four types of compromise principles including equivalent substitution,limit modification,data protection and authorization solicitation in order to exercise of the right to be forgotten in the process of Archives utilization.Finally,feasible paths are proposed in accordance with the four aspects of legal right confirmation,subject domain division,data layering and security protection to seek adjustable space of incorporating the concept of the right to be forgotten in Archives utilization.
