摘要
《生态环境损害赔偿制度改革方案》为督促义务人切实履行生态赔偿义务规定了非诉与诉讼两条执行路径。结合法律规定与实践情况,对上述两种途径予以细化。在确定生态环境损害赔偿磋商行政性质的前提下,分别从非诉与诉讼两层面出发,为生态环境专项司法体系建设提供理论依据。尝试跳出现有制度困囿,将执行手段仅限于非诉手段,提高生态公益的维护效率。
The Reform Plan of Compensation System for Ecological and Environmental Damage stipulates two execution paths of non-litigation and litigation for urging obligors to earnestly fulfill ecological compensation obligations.The two approaches should be detailed by combining legal provisions and practical conditions.On the premise of determining the administrative nature of ecological damage compensation consultation,provide theoretical basis for the construction of ecological environmental special judicial system from non-litigation and litigation levels respectively.Try to break out of the dilemma of the existing system and limit the enforcement means to non-litigation means,so as to improve the efficiency of maintaining ecological public welfare.
