摘要
大数据和互联网的普及,导致一大批以数字经济为基础的互联网平台大量涌现,与此同时,垄断问题也日益突出,而反垄断的难点在于对互联网平台市场支配地位的认定问题。互联网平台最突出的特点在于其经营的双边性,且特别注重用户使用量。因此,在判断互联网平台是否具有市场支配地位时应当着重考虑用户数量,而用户数量的判断又需要结合用户使用时间、登录次数等作综合评判,如此才能更加准确地判断互联网平台是否具有市场支配地位认定。
The popularization of big data and the Internet has led to the emergence of a large number of Internet platforms based on the digital economy.Meanwhile,anti-monopoly issues have become increasingly prominent.Among them,the difficulty of anti-monopoly lies in determining the dominant position of the Internet platform market.The most prominent feature of the Internet platform lies in the bilateral nature of its operations,with special emphasis on user usage.Therefore,when judging whether the Internet platform has a dominant market position,the number of users should be considered,and the judgment of the number of users needs to be combined with the user’s using time,the number of logins,etc.to make a comprehensive judgment,so as to more accurately identified whether the Internet platform has a dominant market position.
