史主法辅:新时代党内法规的研究方法

以党的十八届四中全会将党内法规正式列入社会主义法治体系为起点,有关党内法规的理论研究驶入快车道,探索适合党内法规自身属性的方法论成为新时代党内法规研究的核心任务之一。基于中国共产党领导核心的长期实践与党规本质属性一以贯之的历史传承,党内法规研究必须贯彻以史为主的原则;又基于党规与国法的法律性质差异以及国法同化党规后遗症颇多的现实,党内法规研究还应坚持以法为辅的原则。两方面结合起来,新时代党内法规研究要坚持的方法就是史主法辅。当然,未来党内法规研究在构建方法论体系时还应在兼容并蓄与循序渐进中展开,为全面从严治党与全面依法治国战略目标的实现提供智力支持。

Starting from the Fourth Plenary Session of the 18th Central Committee of the Communist Party of China,Inner Party laws were formally included as part of the socialist legal system.Both the construction of Inner Party laws and theoretical research have entered the fast lane.explore and establish a suitable methodology is becoming one of the core tasks for Inner Party laws research.The inheritance of the CPC's core position of leadership and the nature of party rules requires that the study of party rules must be based on historical data.Based on the differences in the nature of inner Party laws and national laws and the problems arising from the assimilation of the two,the study should be supported by the perspective of law.In the future,the construction of the research method system of inner Party laws must take into account the characteristics of diversity and development,in the process of realizing the goal of comprehensively administering the Party strictly and ruling the country according to law,the study of inner Party laws and regulations should contribute more wisdom and programs.
