食品安全抽检是市场监督管理部门对食品质量安全进行监督检查、风险排查和形势分析的主要方式之一,是食品安全监管的重要技术支撑。食品安全抽样检验涵盖食品抽样和食品检验两大环节,涉及行政机关、检验机构、食品生产经营者等多方主体,法律关系较为复杂。其中,作为食品安全抽样检验的首要环节,食品抽样工作的法律问题更为突出。本文结合食品安全抽样检验工作实务,着重就食品抽样过程中涉及的法律问题展开研究,并尝试提出针对性法律建议。

Food safety sampling and testing is one of the main tools for market regulatory departments to supervise and inspect food quality and safety,and conduct risk screening and market analysis.It is an important technical support for food safety supervision.Food safety sampling and testing covers the processes of sampling and testing,and involves administrative agencies,testing institutions,food producers and distributors,and complex legal relationship.The legal issues related to food sampling are especially prominent.This paper makes an empirical study of the legal issues involved in food sampling and testing and puts forward suggestions.
