开放许可中专利行政部门的智能化服务制度研究

A Research on Intelligent Service System of Patent Administration Department in Open Licensing

最近第四次修订后的《专利法》引入了专利开放许可制度,出台的《专利法实施细则修改建议》完善了专利行政部门的服务职能,但为了提高专利交易效率,还需要利用现代信息技术来提高其智能化服务水平,这不仅顺应了价值互联网时代政府服务的智能化趋势,而且实现了技术创新和制度创新的融合,纾解了制约专利转化效率的信息不对称困境。鉴于智能化服务元素初见端倪和抽象的服务内容尚需细化的现状,未来需要充分利用区块链、大数据、人工智能技术来丰富智能化服务内容,拓宽智能化服务的技术路径,并完善相关制度。

The patent open licensing system is introduced in the fourth reversion of"The Patent Law"and the service functions of the patent administrative department has been improved in"The Proposals for Amendments to the Implementation Regulations of the Patent Law".The paper argues that IT should be used to improve the efficiency of patent transactions and it is viewed as a trend of government services and it also help to realize innovation integration of technology and institution and relieves information asymmetry dilemma.The emerging intelligent service and abstract service content call for integrated intelligent service mechanism by using blockchain,big data,and artificial intelligence technology so that the technical path of intelligent services is broadened in the technical dimension.
