中国当代法律社会史研究的价值、导向及其进路

The Value,Orientation and Approach of the Research on Chinese Contemporary Legal Social History

中国当代法律社会史是一个可以多视角审视、多层次观察、多领域延展的拓荒性研究命题。积极开展中国当代法律社会史研究,揭示中国当代法律发展与社会变迁之间的内在联系,探求中国当代法律与社会演变的历史规律,确立中国当代法律社会史研究范式,具有极为重要的现实意义。开展中国当代法律社会史,既需要有理论的关怀、通史的关怀,也需要坚持问题导向、注重资料挖掘,还应有“瞻前顾后”的意识。中国当代法律社会史有多种研究进路,既可按照现行社会能够与法律产生关联的组成部分分别进行研究,也可根据现行部门法的划分标准分门别类开展研究,还可以新中国的历史分期为分析框架。同时,作为跨学科交叉研究,中国当代法律社会史应充分借鉴社会史和法社会学等学科的优秀研究成果,开拓研究视野,丰富选题内容,如此才能最终呈现一幅形象生动的当代中国法律与社会发展的动态图景。

The Chinese contemporary legal social history is a pioneering research proposition that can be examined from multiple perspectives,observed at different levels and extended in many fields.It is of great practical significance to actively carry out the research on Chinese contemporary legal social history,reveal the internal relationship between the development of contemporary law and social change in China,explore the historical law of the evolution of Chinese contemporary law and society,and establish the research paradigm of Chinese contemporary legal social history.In order to develop the research on Chinese contemporary legal social history,we need not only theoretical care and general history concern,but also the continued attention of problem-oriented method and data mining,and we should also have the consciousness of“looking ahead and looking back”.There are many research approaches to the Chinese contemporary legal social history.The research can be conducted separately according to different components of the current society that can be related to the law,or be carried out in different categories according to the classification standards of the current department law,and the historical stages of New China can also be used as the analytical framework.At the same time,as an interdisciplinary study,Chinese contemporary legal social history should adequately draw on the excellent research achievements of social history and sociology of law,broaden the research horizon and enrich the content of topic selection,so as to finally present a vivid dynamic picture of the development of law and society in contemporary China.
