法治“全国一盘棋”初探——由一件涉诉信访案件引发的反思

A Probe into Rule of Law of the Nation as in a Game of Chess--A Reflection on a Petition Case Involving a Lawsuit

本文通过对一件涉诉信访案件及其办理进行“全景式”的展现,进而对该案及其办理情况进行反思——反思纠纷是如何产生的,如何第一时间更好地介入,反思“案结事不了”尴尬情形如何形成的,如何才能避免或者消解这种窘境。通过反思,进一步探究问题的解决思路—只有坚持“法治一盘棋”思想,从立法、执法、守法、护法等多个方面,尤其是执法层面协调联动、共同发力、务实高效,才能解决当前法院“人案矛盾”及化解矛盾维护社会发展稳定大局。这也是本文“以案说法、以案说理”、探究国家法治通途的作文目的之所在。

This article shows a panoramic picture of a petition case involving a lawsuit and its handling process.Then the author gives reflection on how the case generates,how to better intervene in the first time,why some cases fail to be ended and how to avoid or counteract this embarrassed situation.Based on this,the author probes on possible resolution thought,i.e.the“rule of law”and“a game of chess”thought,which refers to General Secretary Xi’s holistic and systematic thought of governing the country according to law.The author states that the thought should be implemented from the aspects of legislation,law enforcement,law compliance and law protection in a coordinated manner,especially in the level of law enforcement,making joint efforts,being pragmatic and efficient.This should be the fundamental way to dissolve conflicts and cases in court,resolve social contradictions and maintain overall stability for social development.Also this is the purpose of the article and the author to attempts a new idea to implement and improve the rule of law practice over the country.
