中国犯罪论体系研究范式是中国犯罪论体系研究所选取的哲学立场、所确定的价值取向和所采用的学术方法等的集合体。主观主导范式、权力主导范式和本本范式分别是中国四要件犯罪论体系研究范式的哲学立场层面、价值取向层面和方法论层面;三重分立范式、权利主导范式和教义学范式分别是中国阶层式犯罪论体系研究的哲学立场层面、价值取向层面和方法论层面。融合范式、社会回应功利范式和学科群范式应分别构成中国阶层式犯罪论体系研究范式在哲学立场层面、价值取向层面和方法论层面的新走向。由融合范式、社会回应功利范式和学科群范式集合而成的研究范式将导引中国阶层式犯罪论体系的进一步发展。中国犯罪论体系研究范式的更替是中国犯罪论体系发展的结构性描述;中国犯罪论体系研究范式的回顾与展望是促进中国犯罪论体系进一步发展的一次学术总检讨。最终结论是:社会发展的历史性需要影响着哲学思潮的变动,哲学思潮的变动又牵动着犯罪论体系的演变,而哲学立场则是犯罪论体系的根基性因素。于是,犯罪论体系的研究应回应社会发展的历史需要,同时响应相应历史阶段的哲学思潮。

The research paradigm of the Chinese criminal theory system is the aggregation of many elements such as philosophical positions,value orientations and academic methods selected by the research of Chinese crime theory system.The subjective dominant paradigm,power dominant paradigm and bookishness paradigm correspond to the philosophy standpoint,value orientation and methodology level of the research paradigm of Chinese four elements criminal system;the triple separation paradigms and the right dominant paradigm and the doctrine paradigm correspond to the philosophy standpoint,value orientation and methodology level of the research of the Chinese hierarchical criminal theory system.The integration paradigm,social response utilitarian paradigm and disciplinary group paradigm should respectively constitute the new trend of the research paradigm of the Chinese hierarchical criminal system at the level of philosophy position,value orientation and methodology.The research paradigm,which is a collection of integration paradigm,social responsiveness utilitarian paradigm and disciplinary group paradigm,will leads the further development of Chinese hierarchical criminal system.The replace of the research paradigm of the Chinese criminal theory system is a structural description of the development of the Chinese criminal theory system.The retrospect and prospect of the research paradigm of the Chinese criminal theory system is a general academic introspection to promote the further development of the Chinese criminal theory system.The final conclusion is that the historical requirements of social development affect the changes of philosophy thoughts,and the changes of philosophy thoughts affect the evolution of the criminal theory system,while the philosophy standpoint is the fundamental factor of the criminal theory system.Therefore,the study of the criminal theory system should respond to the historical needs of social development,and at the same time it should respond to the philosophy thoughts in the corresponding historical stage.
