摘要
教师如何科学而规范地行使教育惩戒权是新时期我国基础教育改革的重点和难点。教育惩戒并非单纯的法律行为,更主要的是教育行为。教师行使教育惩戒权既要有章有法,又要有理有据,有一定的专业性和灵活度,教育惩戒权具有一定的法理弹性。教育惩戒权的法理学逻辑是“犯错-惩罚”,教师对学生施以不愉快的影响,以抑制学生不当行为,使学生弃恶从善。教师行使教育惩戒权,应遵循合法性、合理性、教育性、灵活性原则。教师行使教育惩戒权必须合法合规,在法律规制的范围内使用好教育惩戒这把“戒尺”。我国现行教育法规将教育惩戒界定为教育行为,允许教师在必要的情形下选择合适的教育惩戒方式,教师的教育惩戒行为具有情境性和可变通性,具有一定范围的弹性空间。
The scientific and standardized manner of education discipline is the focus and difficulty of the basic education reform in our country.Educational Disciplinary is not a purely legal act,but an educational act.Teachers must have rules and laws to exercise the educational punishment and have a certain degree of professionalism and flexibility.The right of educational punishment has a certain degree of legal flexibility.The jurisprudential logic of the educational discipline is"make mistakes-punishment".Teachers take unpleasant influence on students to restrain students'misbehavior and make students abandon evil and do good.Teachers shall follow the principles of legitimacy,rationality,education,and flexibility when exercising their right of educational discipline.Teachers must be legally compliant to exercise their power of educational discipline,and use the"rules"of educational discipline within the scope of legal regulations.The current education regulations in our country define educational discipline as educational behavior.We allowed teachers to choose appropriate methods of educational discipline under necessary circumstances.Teachers’educational discipline behavior is contextual and flexible,and has a certain range of flexibility.
