区块链技术作为一种底层架构技术,具有去中心化、不可篡改、加密安全的特点,被广泛应用于各个领域。在法律领域证据取证方面,应用区块链技术能够准确识别证据的来源与真伪,保证证据的真实性与可靠性。为此,最高人民法院发布的《关于互联网法院审理案件若干问题的规定》确定了区块链证据的法律地位,互联网法院也对涉区块链证据案件作出裁判,并上线了司法区块链平台,但我国目前在应用区块链技术取证方面仍存在很多不足,需要准确把握已有实践中存在的不足之处并不断加以完善,使区块链技术能够更好地应用于证据取证的过程。

As an underlying architecture technology,blockchain technology is widely used in various fields duto its advantages of decentralization,tamper proof and security with encryption. In the field of legal evidenccollection,,the application of blockchain technology can accurately identify the source and authenticity oevidenceand ensure the authenticity and reliability of evidence. Thus,the validity of blockchain evidenchas been legally determined in Provisions on Several Issues Concerning the Trial of Cases by InterneCourts issued by the Supreme People’s Court of the PRC. Internet courts have also made judgments on thcases involving blockchain evidence and launched the judicial blockchain platform. Nevertheless,there ardeficiencies in the taking of evidence through blockchain,we need to precisely identify the existindeficiencies in the practice and constantly make improvements on them so as to make better application oblockchain technology to the taking of evidence.
