青岛市农村土地流转中村委会行为偏差分析与矫正对策

Analysis and Correction Countermeasures of the Behavior Deviation of Village Committee in Rural Land Transfer of Qingdao

依据现行的法律法规结合实地调查分析了青岛市农村土地流转中村委会的规定角色,主要有土地流转信息的管理者、土地流转中村民合法权益的保障者、土地流转行为的监督者以及土地流转中的村集体经济组织的代理人等,全面阐述了青岛市农村土地流转中村委会的规范性行为及其行为偏差。结合青岛市农村土地流转的实际提出消除行为偏差的对策建议:村委会要把尊重和保护村民利益摆在土地流转工作的首位、村委会在土地流转中要尊重村民意愿、村委会在土地流转中要认真履行土地流转后的监督管理职责、严格规制村委会的越权行为等,以使村委会在土地流转中回归本来的行为选择。

According to the current laws and regulations,this paper analyzes the stipulated role of village committee in rural land transfer in Qingdao through field investigation.The role mainly includes the manager of land transfer information,the protector of villagers' legitimate rights and interests in land transfer,the supervisor of land transfer behavior and the agent of village collective economic organizations in land transfer,etc.The normative behavior and behavior deviation of village committee in rural land transfer in Qingdao are com prehensively expounded in this paper.Based on the practice of rural land transfer in Qingdao,the countermeasures and suggestions for eliminating behavior deviations are put forward.The village committee should put respect and protection of the interests of villagers at the top of the land transfer work.respect the willingness of villagers in land transfer.perform the supervision and management res ponsibilities after land transfer,and strictly regulate the excessive acts of village committee.in order to make village committee back to its original behavior choice in land transfer.
