依法治国视阈下农民工契约精神培育路径研究

Cultivating Farmer-Workers’Contract Spirit from the Perspective of Rule-of-Law

契约是双方当事人基于各自利益最大化而达成的妥协。契约精神就是避免冲突,主张协商,达成共识并坚决贯彻执行共识的自觉意识。依法治国战略能否全面推进,与农民契约精神密切相关。在农民工市民化进程中,农民工契约精神直接关乎社会公平、和谐、稳定,是“四个全面”战略目标顺利实现的重大理论和现实课题。换言之,没有城市化进程中农民工契约精神的提升,也就没有依法治国战略和全面建成小康社会目标的实现。

A contract is a compromise made by two parties to maximize their respective interests。The spirit of contract is the conscious consciousness of avoiding conflict,advocating consultations,reaching consensus and resolutely implementing consensus。Whether the strategy of governing the country according to law can be comprehensively pushed forward or not,it is closely related to the contract spirit of farmer workers。In the process of farmer workers’migration to the city,the contract spirit is directly related to social equity,harmony and stability,which is a major theoretical and practical issue of"four comprehensive"strategic objectives。In other words,if there is no improvement of the contract spirit of farmer workers in the process of urbanization,without the realization of the goal of building a well-off society and the strategy of Rule-of-Law.
