委员会是我国行政组织领域存在的客观现象。根据法律地位不同,其可以分为机关型委员会与机构型委员会。委员会在不同领域、不同阶段行使着不同性质的权力,是国家治理体系的重要组成部分。有必要从依法行政特别是法律保留的角度审视其存在与合法性。为实现委员会与法治政府建设的衔接,应当从设立与运转两个阶段对其进行过程规制。

The committee is an objective phenomenon in the field of administrative organization in our country.According to its legal status,the committee can be divided into organtype committee and unittype committee.The committee exercises powers of different natures in different fields and stages,and is an important part of the national governance system.It is necessary to examine the existence and legality of the committee from the perspective of the lawbased administration,especially the reservation of law.In order to realize the convergence between the committee and the construction of the rule of law government,the process regulation should be carried out from the two stages of establishment and operation.
