公海保护区禁止性保护与合理利用的关系研究

当前人类在公海活动的自由使公海生态环境遭到日益严重的破坏,海洋生物的多样性正在减退,对公海区域开展保护已经成为重要的国际议题。面对脆弱的海洋生态系统,在特定区域建立公海保护区,是改善这一现状的理想方式。目前对于公海保护区的相关法律研究已经初见成果,随着公海保护区制度的不断发展,对于公海保护区的具体问题研究还需要进一步深化。通过对公海保护区的禁止性保护与合理利用之间的关系进行研究,并分析二者之间的冲突,能够进一步探讨出协调的路径。协调公海保护区的禁止性保护与合理利用活动的核心,是坚持在现有的国际海洋法框架下建立公海保护区,通过综合考察对保护时效进行合理界定,秉承可持续利用的保护理念推进公海保护区的设立和发展。

At present,the freedom of human activities on the high seas has caused increasingly serious damage to the ecological environment of the high seas.The diversity of marine life is gradually declining,and the protection of high seas areas has become an important international issue.In the face of fragile marine ecosystems,it is an ideal way to establish high seas protected areas in specific areas to improve this situation.At present,the relevant legal research on the high seas protected areas has already yielded initial results.With the continuous development of the high seas protected area system,the research on the specific issues of the high seas protected areas needs to be further deepened.By studying the relationship between prohibited protection and rational utilization of high seas protected areas,and analyzing the conflict between them,we can further explore the path of coordination.The core of coordinating prohibitive protection and rational use of high seas protected areas is to insist on establishing high seas protected areas under the existing international law of the sea framework,rationally define the protection timeliness through comprehensive investigations,adhering to the protection concept of sustainable use to promote the establishment and development of high seas protected areas.
