传染病暴发期间非疫慢性病患者的权益保护

PROTECTION OF RIGHTS AND INTERESTS OF UNINFECTED PATIENTS WITHCHRONIC DISEASES DURING OUTBREAKS OF INFECTIOUS DISEASES

在传染病暴发期间,非疫慢性病患者的权益受到一定程度的损害。针对这一问题,作者结合医学伦理学基本理论和文献报道,从健康与公共卫生伦理的视角考察了非疫慢性病患者在疫情防控期间受到的影响,并将其划分为生命健康权益、社会经济权益和个人隐私权益3个方面的损害分别加以讨论。通过对现象背后的伦理学冲突进行分析,阐明了暴发传染病防控时期以整体效用和社会公正为主导的前提下,患者个人生命健康和社会经济权益遭受损害的必然性,并揭示了个人隐私权益损害背后的“尊重”观念缺失;进而从国家、社会和个人的层面分别提出了维护非疫慢性病患者权益的举措,以期促进疫情防控新形势下该群体的权益保障。

During the outbreaks of infectious diseases,the rights and interests of uninfected patients with chronic diseases are considered to be impaired.To address the issue,we studied how uninfected patients with chronic diseases can be influenced from the perspective of public health ethics,and divided the effects into three aspects which are named as life and health rights and interests,socio-economic rights and interests,and privacy rights and interests,according to the theory of ethics and related literature.After analyzing the ethical conflicts underlying the phenomenon,we expounded that during the outbreaks of infectious diseases,the rights and interests of socio-economic and life and health were bound to be inevitably damaged,on the premise of mainly stressing on social justice and overall utility.Moreover,we revealed the lack of concept of respect contributing to the impairment of privacy rights and interests.Furthermore,we showed a list of means to protect the rights and interests of uninfected patients with chronic diseases,so as to faciliate the advance of research.
