党内法规理论体系是党内法规制度体系的行动指导。在提高党内法规执行力的实践行动大背景下,进一步加强党内法规规范效力理论体系建设具有重要的理论和实践价值。党内法规的内在执行力源于规范效力逻辑。党内法规作为一种自制规范,其普遍约束力和反复适用性源于其独特的效力来源体系。党内法规的规范效力本质上是意志与规律的结合、权力约束和权利保障的统一、利益性与正义性的融合。党内法规的“秩序创造”职责主要通过“指引”“预测”“评价”这三大规范效力功能予以实现。“公定力”“确定力”“拘束力”“执行力”共同构成了党内法规的规范效力内涵。

The theoretical system of laws and regulations within the Party is the guidance for actions of the laws and regulations within the Party.Against the background of practical actions to improve the enforcement of internal Party laws and regulations,the construction of a theoretical system for the effectiveness of internal Party laws and regulations should be further strengthened.The internal enforcement of the Party’s laws and regulations stems from the logic of normative effectiveness.As a kind of internal self-control regulations,the Party’s internal laws and regulations,their universal binding force and repeated applicability stem from its unique source system of effectiveness.The normative effect of the Party’s laws and regulations is essentially the combination of will and law,the unity of power self-control and rights protection,and the integration of interests and justice.The“order creation”responsibility of the Party’s laws and regulations is mainly realized through the three major normative functions of“guidance”,“prediction”and“evaluation”.The“public determination force”,“determining force”,“binding force”and“execution force”together constitute the basic connotation of the effectiveness of the Party’s laws and regulations.
