A New Analysis of the Mechanism of Administrative Reconsideration Committee

为解决长期以来行政复议运行效果不佳的问题,实践中比较早地推行了行政复议委员会制度。自试点以来,该机制已取得了一些成绩,积累了一些经验。当前《行政复议法》修改在即,司法部发布的《行政复议法(修订)(征求意见稿)》也规定了行政复议委员会制度。但对行政复议委员会这一焦点问题,如果不实质性地加以研究而仓促入法,其结果只能是于事无补。必须以实质性解决行政纠纷为宗旨,构建起兼具实践性和有效性的行政复议委员会制度。其中,行政复议委员会的功能定位、运行机制、审理决定的作用等几个问题尤为重要。要真正发挥行政复议的定分止争功能,并将其打造成解决行政纠纷的主渠道,需要进行制度的系统性改革。

In order to resolve the problem of poor efficiency of administrative reconsideration which existed for a long period,the Administrative Reconsideration Committee was formed in the reforming practice.Since the pilot project be initiated,the administrative reconsideration committee has made achievements and accumulated experience.The Administrative Reconsideration Law is about to be revised,and the Administrative Reconsideration Law(Revised)(Draft for comments)issued by Ministry of Justice also stipulates the system of administrative reconsideration committee.However,if the focus of the administrative reconsideration committee is not studied substantively and hastily incorporated into the legal framework,the result will be useless.It is necessary to build a practical and effective Administrative Reconsideration Committee system with the purpose in resolving administrative disputes substantively.Among them,the function orientation of the Administrative Reconsideration Committee,the operation mechanism of the Administrative Reconsideration Committee and the role of the Administrative Reconsideration Committee in hearing decisions are particularly important.If we want to fully function of administrative reconsideration,as well as achieving the goal of making administrative reconsideration the main channel to solve administrative disputes,the systematic reform of the system shall be implemented.
