摘要
我国正处于基本养老保险制度由"碎片化"向"并轨制"改革的关键时期。我国现阶段缺乏一部能有效统领基本养老保险制度的高效力层次的立法。现阶段养老保险制度实施在基本养老保险费率、养老保险替代率、职业年金与企业年金等方面存在共性问题。同时,具体的"并轨"改革还存在缺乏高效力层次的养老保险法统领、转轨衔接受阻、实质待遇未变、人才流动受阻的个性问题。完善思路是针对我国养老保险存在的共性问题和"并轨"改革中存在的个性问题,明确公平优先兼顾效率的改革理念、建立工资和养老待遇分配的平衡调控机制、统合养老保险机制,促进人员流动、建立公开透明的监督机制。
My country is in a critical period of reforming the basic pension insurance system from"fragmentation"to"consolidation".At this stage,my country lacks a high-efficiency level of legislation that can effectively govern the basic pension insurance system.At this stage,the implementation of the old-age insurance system has common problems in basic old-age insurance rates,old-age insurance replacement rates,occupational annuities and enterprise annuities.At the same time,the specific"combination"reforms still have personality problems such as the lack of high-efficiency pension insurance law leadership,barriers to acceptance of transitions,unchanged substantive benefits,and hindered talent flow.The perfect idea is to address the common problems in my country’s pension insurance and the individual problems in the"combination"reform,clarify the reform concept of fairness,priority and efficiency,establish a balanced regulation mechanism for the distribution of wages and pension benefits,integrate the pension insurance mechanism,and promote the flow of personnel Establish an open and transparent supervision mechanism.
